Terms of Service

Review Gearuum's Terms of Service for the invite-only beta, including acceptable use, billing, user content, and liability terms.

Beta Program Notice — Please Read

Gearuum is currently in an invite-only beta. By using the Service during this phase, you understand and agree that:

  • Features, pricing, and functionality may change or be removed without notice.
  • The Service may experience downtime, bugs, or data loss. We do not guarantee uninterrupted or error-free operation during beta.
  • If your invite access is revoked or the beta program ends, we will make reasonable efforts to give you a window to export your data before any deletion — but this cannot always be guaranteed during the beta phase.
  • Your invite may be limited, paused, or revoked at our discretion during this phase.

This notice supplements, and does not replace, the full Terms of Service below.

Terms of Service

1. Acceptance of Terms

By creating an account or using Gearuum (the "Service"), operated by Corentin Cocoual, doing business as "Gearuum App" ("Gearuum," "we," "us"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Gearuum is a gear management platform for outdoor enthusiasts, allowing users to catalog, organize, and share outdoor equipment ("gear"). The Service is currently offered on an invite-only basis (see Beta Program Notice above). We may add, modify, or discontinue features at any time.

3. Eligibility & Accounts

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at the contact below if you suspect unauthorized use.

4. User Responsibilities & Acceptable Use

You agree not to: use the Service for any unlawful purpose; upload content you don't have the right to share; attempt to reverse-engineer, scrape, or disrupt the Service; or infringe the rights of other users or third parties. You are solely responsible for the gear information, photos, and other content you upload ("User Content").

5. User Content & Third-Party Processing

You retain ownership of your User Content. By uploading content, you grant Gearuum a limited license to store, display, and process it solely to provide the Service to you (e.g., displaying your gear inventory, sharing kits with people you choose).

To identify and extract gear details from photos, we send uploaded images to third-party AI services (currently Google Cloud Vision and the OpenAI API) for processing. We do not use your User Content to train AI models, ours or these third parties' — neither Google nor OpenAI use data submitted through their business APIs for model training, per their current published policies. 6. Billing and Payments

Some features require a paid subscription plan, processed via Stripe. By subscribing, you agree to: automatic renewal at the then-current price unless canceled before the renewal date; charges in Canadian Dollars (CAD) unless stated otherwise; and price changes taking effect no earlier than your next billing cycle, with advance notice. Refunds are considered on a case-by-case basis — contact contact@gearuum.com to request one. During the invite-only beta, some or all paid features may be offered free or at a discount at our discretion.

7. Intellectual Property

The Service, including its design, code, and branding, is owned by Gearuum and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose — this is a license to use the Service, not a license to the underlying software. You may not copy, modify, or create derivative works from the Service itself. You retain all rights to your own User Content as described in Section 5.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not guarantee the Service will be uninterrupted, secure, or error-free — this is especially true during the beta phase described above.

9. Limitation of Liability

To the maximum extent permitted by law, Gearuum shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us, if any, in the 3 months preceding the claim.

10. Termination

You may stop using the Service at any time. To delete your account, contact contact@gearuum.com — we'll process the request as described in the Privacy Policy. We may suspend or terminate your access — including revoking beta invite access — at our discretion, particularly for violations of these Terms. See the Beta Program Notice above regarding data export on termination during beta.

11. Governing Law & Disputes

These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada. Any dispute arising from these Terms or the Service will be submitted to the competent courts of the Province of Quebec.

12. Changes to These Terms

We may update these Terms from time to time. We'll post the updated version here with a new "Last updated" date; continued use of the Service after changes take effect constitutes acceptance.
